Trulock Found Guilty in Cherry Pit Case

After deliberating for 45 minutes, a jury found Cherry Pit owner Jim Trulock guilty on all 10 counts brought against him. His total fine will be $7,500. Trulock never took the stand in his defense.

Cherry Pit defense attorney Ed Klein told CBS 11 the case speaks to Duncanville’s “intolerance” of other lifestyles. Klein said the city had no proof of sexual activity in the home, while prosecutor Kim Lafferty said Web advertisements and conduct observed by city officials provided ample evidence.

Court dates related to charges regarding Texas Alcoholic Beverage Code violations and suspicion of organized crime are pending.

Prosecution Rests in Cherry Pit Trial

Tuesday, October 28th, 2008

One local newscaster referred to it as the most publicized Class C misdemeanor trial in history and that’s an accurate description. The prosecution has rested its case in this much discussed trial about a “swingers club” in the City of Champions.

Defense attorney Ed Klein argued that no city employees witnessed any sexual activity in the home and thus have no evidence to base their case on. Cherry Pit co-owners Jim Trulock and Julie Norris face five citations of operating a sexually oriented business without a permit and another five charges of operating a sex club. After this trial, the pair also face charges pertaining to organized crime and Texas Alcoholic Beverage Code violations.

A July raid turned up large amounts of alcohol at the residence leading to possible charges on operating a bar without proper licensing.
